The Constitution of the Republic of Estonia states that circumscription of rights and freedoms must be necessary in a democratic society and may not distort the nature of the rights and freedoms circumscribed.
Fundamental rights are often thought to be a constraint on democracy. The argument runs as follows: it is fine to let the people decide, but only to the point where their freedom of decision-making meets the boundaries of constitutional rights and freedoms. If one adopts this perspective, the Ombudsman will appear if not hostile to democracy, then at least as a counter-force.
What does the rule of law or the principle of equal treatment mean in practice? How can we be sure that everyone's rights enshrined in the Constitution are protected? Chancellor of Justice Ülle Madise, Legal Advisor to the President of the Republic Hent Kalmo and Attorney-at-Law Paul Keres discussed these and many other questions. The discussion was moderated by Eva Ladva, media literacy specialist at the National Library.

The Chancellor of Justice is an independent constitutional institution appointed to office by the Riigikogu (parliament) on the proposal of the President of the Republic for a term of seven years. The Chancellor’s task is to make sure that legislation valid in Estonia is in conformity with the Constitution and that the fundamental rights and liberties of people in Estonia are protected.

Ülle Madise, the Chancellor of Justice, calls upon the Riigikogu to amend laws in such a way that the rights of all members of the councils of local authorities would be safeguarded, for instance, the right to participate in the work of the committees of the council as well as the right to defend their rights in court.

The Annual Report 2017-2018 covers the period from 1 September 2017 to 31 August 2018. The report has been published in a new web form and it includes information on children's rights, inspection visits, local authorities, equal treatment, courts and many other topics.
